General terms and conditions of use of econom.ee online shop:

1.GENERAL TERMS AND CONDITIONS

1.1 These terms of use limit the rights and obligations between the customers of the online shop www.econom.ee (hereinafter referred to as the Customer) and Econom OÜ (hereinafter referred to as econom.ee) when concluding a transaction (purchase of goods). The exchange of goods takes place on a legal basis.

1.2 All registered econom.ee users and guests who wish to purchase products are subject to these terms and conditions, product prices, product information and the legislation of the Republic of Estonia. 

1.3 econom.ee reserves the right to unilaterally amend the general terms and conditions of use of the online shop www.econom.ee, change the terms and conditions of sale and prices. All changes shall come into effect as of the moment the information appears on www.econom.ee. 

1.4 If the Customer has placed an order before the amendments to the terms and conditions come into force, the terms and conditions of purchase in force at the time of the order will apply to that order, unless otherwise provided by law or these terms and conditions.

2. PRICING

2.1 All prices of the online shop www.econom.ee are in euros (€) and include sales tax.  

2.2 Prices for the goods do not include delivery. The cost of delivery depends on the delivery method chosen by the Customer and is indicated separately in the invoice.

2.3 econom.ee reserves the unilateral right to change product prices.

2.4 If the Customer has placed an order before the price of the goods has changed, the Customer shall receive the goods at the price that was valid at the time of the order. econom.ee shall not refund the difference in the price of the goods.

2.5 The price valid for the purchased goods is displayed in the shopping basket, when placing an order. 

3. PURCHASE AND PAYMENT FOR GOODS

3.1 econom.ee sells, the Customer buys the offered goods in the online shop www.econom.ee. 

3.2 After confirming the order, the Client receives an invoice to his contact e-mail address. If the Customer has not received the invoice and order confirmation, please inform the Customer at info@econom.ee.

3.3 The invoice that is sent to the Customer contains the selected goods, the method and cost of shipping, the Customer's contact details, as well as all details for payment of the invoice. 

3.4 When placing an order, the Customer has the right to choose a suitable method of payment (via internet bank, credit card, cash) and the method of receiving the goods. 

3.5 A purchase agreement concluded between econom.ee and the Customer shall enter into force upon confirmation and 100% payment of the order. All concluded agreements are stored in econom.ee's database.

3.6 The order shall be completed within one working day after the payment has been received by econom.ee. 

3.7 If the Customer has not paid the invoiced amount within 2 working days, econom.ee has the right to cancel the order. 

3.8 When placing and paying for an order in our online shop, the Customer confirms that he/she has read the general terms and conditions of use, fully agrees with them and will comply with them. 

4. DELIVERY OF GOODS AND HANDOVER

4.1 After conclusion of the transaction (payment of the invoice for the goods), the order is completed and dispatched to the address specified by the Customer. 

4.2 The delivery times of the goods specified in the online shop www.econom.ee are valid from the moment of payment of the invoice and depend on the method and place of delivery.

4.3 If the Customer wishes to change the delivery address, he must notify econom.ee at the earliest opportunity. If the order has already been sent to the specified address, the place of delivery cannot be changed. 

4.4 After dispatch of the parcel, econom.ee will send a notification to the Customer's e-mail address.

4.5 The accuracy and correctness of the data provided by the Client depends on the prevention of delays and misunderstandings in the delivery of the goods. econom.ee shall not be liable for delays and misunderstandings caused by inaccurate or incorrect data provided by the Customer when placing an order. 

4.6 If the goods (but not the packaging) have been damaged during transport, econom.ee shall be entitled to replace the goods with a new one. If replacement is not possible (due to unavailability of the goods), econom.ee shall pay the Customer the cost of the damaged goods.  

4.7 econom.ee reserves the right to change the terms and conditions of delivery of the goods. 

5. WARRANTIES AND RETURNS

5.1 All goods in the online shop www.econom.ee are on 100% original. Photos are for illustrative purposes and actual goods may differ in colour, shape, size and other parameters from the images on the website. Each sold product has a description, next to the photo, and its expiry date, which is indicated on the package by the manufacturer.

5.2 Based on the Law of Obligations Act of the Republic of Estonia, the Customer has the right to return the goods within 14 days of receipt. The returned goods must be undamaged, unused, labelled and in closed original packaging. 

5.3 When returning the goods, a free-form application must be submitted to the e-mail address info@econom.ee within 14 days of receiving the parcel. The application must include: the reason for the return, the Customer's name and surname, the name of the goods, and the order number. 

5.4 Upon discovery of a defect, the Customer shall notify econom.ee by sending an e-mail to info@econom.ee with the following information: Customer's name and surname, contact details, date, alleged defect of the goods (preferably together with a photo), invoice number or copy of the invoice for the goods. The corresponding statement must be sent no later than 14 days after the discovery of the defect. 

5.5 econom.ee shall not be liable for defects arising: through the fault or negligence of the Customer; through use of the goods other than for their intended purpose; through natural physical wear and tear during normal use.  

5.6 Shipping costs for the returned goods shall be paid by the Customer. ee shall pay for the delivery of the goods only if the goods were defective or did not correspond to the order. 

5.7 The money for the returned goods and shipping shall be paid to the Customer's current account within 30 days of receipt of the goods by econom.ee. 

5.8 If the Customer wishes to exchange the goods for another product or for the same product in a different volume, the Customer shall pay the delivery costs. The only exception is when a defective or non-conforming product is replaced.     

5.9 If the goods received by the Customer turn out to have a defect which could not be detected by external inspection and which did not arise upon opening the packaging, econom.ee shall be entitled to reduce the price of the ordered goods or fully refund the price of the goods to the Customer.

6. LIABILITY AND FORCE MAJEURE

6.1 econom.ee shall be liable to the Customer for damages caused by violation of the terms and conditions of econom.ee in accordance with the legislation of the Republic of Estonia. 

6.2 The Client shall be liable to econom.ee for damages caused by the Client's violation of the terms and conditions of econom.ee in accordance with the legislation of the Republic of Estonia. The Customer shall be fully responsible for the information provided and all consequences that may arise from the data provided by the Customer. 

6.3 Neither party shall be liable to the other party for damage or delay in the delivery of an order if this was caused by circumstances that neither party could have influenced or foreseen (force majeure). Failure to fulfil the parties' obligations under force majeure shall not constitute a breach of these General Terms and Conditions.

6.4 econom.ee shall not compensate for any moral damages that may be caused by changes in delivery times, price changes, etc. under these terms and conditions. 

6.5 econom.ee shall not compensate the Client's expenses caused by circumstances where the Client assumes liability to third parties (beyond econom.ee's control) under conditions contrary to these terms and conditions.

6.6 econom.ee shall not compensate the Customer for lost opportunities caused by changes in prices, delivery dates, etc. 

6.7 econom.ee shall not be liable for service interruptions, delays, errors and website malfunctions resulting from third parties, service and postal companies, as well as malfunctions resulting from force majeure (natural phenomena, power outages, etc.) beyond econom.ee's control.  

6.8 The maximum amount of compensation may be the cost of goods and delivery ordered by the Customer in the online shop www.econom.ee. 

7. CONFIDENTIALITY

7.1 By using the online shop www.econom.ee, the Customer gives his/her express and informed consent to econom.ee's use of the provided personal data. 

7.2 The data communicated to econom.ee shall be used to provide services and services to the Customer and shall be treated confidentially and shall not be passed on to third parties, except in cases where this is implied by the delivery method chosen by the Customer and in cases provided for by law.

7.3 econom.ee reserves the right to provide the Customer with new information about products or companies using the Customer's contact details if the Customer has subscribed to econom.ee's newsletter. The Customer has the right to delete their contact details from econom.ee's database.

7.4 In matters not regulated by these Terms and Conditions, the Client and econom.ee shall be governed by the laws and legislation of the Republic of Estonia.

7.5 In the event of disagreements or disputes arising in the course of fulfilment of these terms and conditions, the parties shall first try to reach an agreement by means of negotiations. If the disputes arising from the agreement cannot be resolved by negotiations, both parties (both the Customer and econom.ee) have the right to apply to the Consumer Protection Board or to a court for the protection of their rights.

8. FINAL PROVISIONS

8.1 The laws and legislation of the Republic of Estonia shall apply to these general terms and conditions of use of econom.ee. If any provision of the terms and conditions of the order is not valid, this shall not affect the validity of the other terms and conditions of the contract and shall be replaced by another provision that is closest to it in terms of legal and economic significance.

8.2 All these matters shall be dealt with in accordance with the rules covered by the laws of the Republic of Estonia.
